As per the Indian Societies Registration Act 1980 and Act related to Societies notified under the various state laws, a Society is required to comply with following compliance:
Note: The above compliances may differ from state to state A society is required to undertake the following types of compliances Intimation of alteration in Memorandum of Association /Rules & Regulations A society is required to intimate to the registrar any alteration in the Memorandum of Association or the Rules & Regulations relating to change in name, any amendment, change in object etc may Form: will differ from state to state Time Limit: generally within 30 days of event Regulatory Authority: Registrar of Societies. Requisite Fees: will differ from state to state (1) Filling of the details of members of governing body of the Society A Society is required to file every year, on or before the 14th day succeeding the day on which, according to the rules of the society, the annual general meeting of the society is held, or, if the rules do not provide for an annual general meeting, in the month of January, a list of the names, addresses and occupations of the governors, council, directors, committee, or other governing body then entrusted with the management of the affairs of the society, with the Registrar of Societies . Form: Not required Time Limit: within 14 days of AGM or in month of January Regulatory Authority: Registrar of Societies. Requisite Fees: will differ from state to state (2) Filing of Balance Sheet and Auditors Report A Society is required to file copy of audited balance sheet, statement of receipts and expenditure account duly certified by at least two members of the governing bodies with the Registrar of Societies Form: Not prescribed Time Limit: within 30 days of AGM or along with list of members of governing body Regulatory Authority: Registrar of Societies. Requisite Fees: will differ from state to state A Society is required to hold an Annual General Meeting of its members once in each calender year within the time prescribed in the rules and regulations. The Annual General Meeting is required to be held for presenting to the members, the statement of activities, the income and expenditure statement and such other information as may be provided in the respective Act or rules and regulations. Statutory Audit A Society is required to get their accounts audited by a practicing Chartered Accountant once in a year. Auditors are required to prepare and sign the report of their observations after auditing the account books. If the Society fails to get the accounts audited, the Registrar may cause the accounts audited by itself and may charge the cost from the Society.
